Products:
The company Laboratoire OBST places at the disposal of the purchaser an online shop allowing to order directly. All our sales offers are subject to availability of the products near our suppliers.
Price:
The prices indicated on the site can be modified constantly. This modification will be announced to the Purchaser before any order. The prices invoicees are those in force at the time of the order. The prices are indicated in Euro HT except for transport costs and shipping.
Delivery, expenses and times:
The carriage costs are calculated compared to the total weight of your goods. They are indicated in your basket before you validate your final order. All our articles are delivered by specialized conveyors. The ordered articles are delivered in the hall of reception or with the dock of unloading if they exist for companies and within main entrance of building for private individuals. Any private individual will have to specify his hours of presences as well as the various elements necessary to our conveyors for the good routing of the products (in the box comment at the time of the passage of the order) at the time of ordering . Deliveries of pallets to stage, in buildings without ascencor etc… are not included/understood in the basic service and the extra cost will have to be estimated (contact us before finalizing your order). Any representation of parcel for nonpresence of the customer will be charged. Attention, in case of non-respect of this procedure Laboratoire OBST will not be responsible for any damage or delivery problem.
In the event of several products, the time of forwarding of the order will be that of the product having the longest time of forwarding. Any delivery delay will not give place to any damage. We will keep you informed by email of the advance of preparation or delivery of your orders. Laboratoire OBST might split the deliveries because of the differences in times which exist between the products of the catalogue. In this case LABORATORY OBST will inform by email of the caused delays and the new delivery periods for the remainders of orders. For any order higher than 800 kg, to contact us: we will establish you an estimate according to your needs (weight of the order, time, place of delivery).
Problem of quality produced or conformity:
In the event of the delivery of a product not corresponding to the order (defective or not in conformity), the Purchaser must formulate his complaint within 48 hour as from the signature of the form of distribution. The complaints must be addressed by registered letter to the addresses indicated above, and must have:
• Purchaser adresse and telephone
• Order references
• References of the product
• Reasons for the complaint.
The return of the products will have to be made within seven working day as from acceptation by LABORATORY OBST. Any product to be exchange or refund will have to be turned over to the Salesman in his state and original packaging and mus contain the whole product and its accessories. The shipping expenses are the responsibility of the Salesman, except if the product does not correspond to the declaration made by the Purchaser. Non-respect of this procedure will cause the Purchaser not to be able to formulate any complaint for nonconformity or apparent defect of the delivered products, the products being then considered in conformity and free from any apparent defect.
Right of Retractation:
In accordance with l' article L 121-16 of the French Code of Consumption, the Purchaser (only if he is a private individual) has got a seven clear days deadline as from the date of reception, to turn over the product to its own expenses, for refunding. The products must imperatively be turned over to the Salesman in a state new and suitable for the resale, in their original state (packaging, accessories, note…), duly sealed, and accompanied by the invoice corresponding to the purchase. Any incomplete product, damaged product or not in the original packaging or deteriorated, neither will be refunded nor exchanged. The right of retractation will give place to a refunding in cash by cheque; this refunding will intervene at the latest in the 30 days following the date on which the right of retractation was exerted under acceptance requirement by the Salesman of the turned over product.
Availability of the products:
Our online shop was built with our own elements, enriched with the information communicated by our suppliers. Some products are not stored within our structure, and our offer in fact is conditioned with the availability of the articles in the suppliers or the manufacturers. The possible stock shortages could not consequently be due to our responsability. In accordance with the statement of article L121.20.3 of the French Code of Consumption, in case of stock shortage, the Salesman might provide a product of equivalent quality and price. If not possible, the Purchaser could be refunded without delay and at the latest in the thirty days of the payment. This refunding will be carried out by cheque. In the event of stock shortage, we will inform you by E-mail of the dates of availability as soon as possible.
For any product that's not on our online store, Laboratoire OBST will try to make an offer in order to answer your request. The photographs and descriptive products presented to the sale are not contractual by no means. In the event of modification of a product by our supplier, the chart of this one could not engage the responsibility for the Salesman, nor to even invalidate the sale.
Order:
Any order is considered as accepted without reserve and according to the present general terms of sale at the moment the purchaser pays by PayPal or check.

Price proposition:
For specific requests for volumes, quantities, products nonpresent on our site or other, please contact us. We will make you an estimate depending on your request, and the goods will then be shipped as soon as we receive your payment of the order.
Payment:
Except specific agreements between the customer and LABORATORY OBST, the payments will be done by PayPal, cheque or bank transfer (in this case, contact us to obtain our bank informations). In the event of nonpayment in the intended deadlines or in the case of recently created companies, LABORATORY OBST reserves the right to require a guarantee.

Clause of reserve of property:
The Salesman owns the property of the product until complete payment, including expenses and taxes. During the period s' running from the delivery to the transfer of property, the risks of loss, flight or destruction are with the Purchaser's responsability. Non execution by the Purchaser of its obligations of payment confers to the Salesman the right to require the immediate restitution of the goods delivered at the expenses and the risks of the Purchaser.
Penalty clauses :
In case of non-payment of the invoices, LABORATORY OBST will charge a penalty of 1,5% per month of delay, calculated on the amount of the sums due with a minimum of 30€ as damages and penalty clause. Non-payment of one part of the price will result in the total invoice becoming immediately exigible.
Attributive clause of jurisdiction:
In the event of a disagreement, it is expressly agreed between the two parts; that exclusive competence is given to the Bankruptcy court of Villefranche S/Saone and Tarare.
Confidentiality and safety:
We commit ourselves in offering you a very high degree of confidentiality and safety regardind the following information:
